1. General Terms and Conditions of Purchase

These Specific Conditions of the Purchase Contract apply to online sales made through the www.marmarina.com website (hereinafter, WEBSITE) owned by FENORGIL S.L., with registered office at C/ Carreño Miranda, 11, 33401 Avilés, with CIF B52531100, registered in the Mercantile Registry of Asturias in Volume 4141, Folio 66, Page AS-48334. 1st registration (hereinafter, MARMARINA) FOR CUSTOMERS DOMICILED IN SPAIN, ANDORRA, GIBRALTAR OR PORTUGAL. For sales outside the national territory, Andorra, Gibraltar and Portugal, the conditions of international online sales will apply.

The use by the customer of the services offered on the WEBSITE presupposes, in any case, the acceptance of these Specific Conditions of the Online Purchase Contract, in the version published by MARMARINA, at the time of the purchase order. Therefore, it is advisable for the customer to read these Specific Conditions before proceeding to make a purchase, as well as the general terms and conditions of use of the portal.

Please also read our Privacy Statement before placing your order. By using or placing an order through this WEBSITE, you agree to be bound by these Terms and our Privacy Statement, so if you do not agree to all of the Terms and Conditions and the Privacy Statement, you should not place any orders.

2. Subject matter of the contract

These specific conditions of online purchase apply to the purchase of any product present on the WEBSITE made by customers who have their delivery address in Spain, Andorra, Gibraltar or Portugal.

The prices of each of the wedding invitations, stationery, envelopes, posters, stamps, hangers, decoration items, gift items, accessories and details are indicated on the website on the date of ordering. Prices are detailed on each item including taxes and fees. The amount of shipping costs and any other service is also specified and will be indicated to the customer in a broken down manner at the time the order is placed.

The purchase service through the WEBSITE regulated in these Specific Conditions only allows the purchase of products and services to customers over 18 years of age and with a delivery address in Spain, Andorra, Gibraltar or Portugal.

MARMARINA reserves the right to cancel a customer's access account if fraudulent, speculative or bad faith acts are detected in the use of this service.

MARMARINA will modify and update, if it deems it appropriate, items and prices in accordance with the company's commercial criteria, although the changes will not affect the products that have been accepted.

All orders for products are subject to availability and, in this regard, if there are difficulties in terms of supply, or if there are no items left in stock, we reserve the right to provide information about substitute products of equal or greater quality and value that the customer may order. If you do not wish to place an order for these replacement products, we will refund any amount that the customer may have paid.

3. Online purchase process

This information and the details contained on the WEBSITE do not constitute an offer to sell, but an invitation to do business. No contract will exist between the customer and MARMARINA in relation to any product until the order has been expressly accepted by MARMARINA (even if the account has already been debited). If the offer is not accepted and your account has already been debited, the amount of the offer will be refunded to the customer in full.

To place an order, the customer must follow the online purchase procedure and click on "Place the order". After this, you will receive an email acknowledging receipt of your order (Order Confirmation). It should be noted that this does not mean that your order has been accepted, as it constitutes a mere offer to MARMARINA to purchase one or more products. All orders are subject to acceptance by MARMARINA which will confirm such acceptance by sending an email informing that the product is being shipped (Shipping Confirmation). The contract for the purchase of a product between MARMARINA and the customer (Contract) will be formalised only when the Shipping Confirmation is sent to said customer with its corresponding invoice.

Only those products listed in the Dispatch Confirmation shall be subject to the Contract. MARMARINA will not be obliged to supply any other product that may have been ordered by the customer until the shipment of the same is confirmed in a separate Shipping Confirmation.

There may even be exceptional circumstances (in accordance with Law 10/2010, of 28 April, on the prevention of money laundering and terrorist financing) that make it necessary to refuse the processing of an order after having sent the Order Confirmation. MARMARINA reserves the right to do so at any time, at its sole discretion.

4. Payment Methods

The price of the products will be that stipulated at any time on the WEBSITE, except in the case of manifest error. Although MARMARINA tries to ensure that all prices listed on the WEBSITE are correct, errors may occur. If MARMARINA discovers an error in the price of the products that the customer has ordered, MARMARINA, after informing the customer as soon as possible, will give them the option of reconfirming their order at the correct price or cancelling it. If MARMARINA is unable to contact the customer, the order will be considered cancelled and the amounts paid will be refunded in full.

MARMARINA is not obliged to supply products (even if the Shipping Confirmation has been sent) if the error in the price is obvious and unequivocal and could have been reasonably recognized by the customer as an incorrect price.

The prices of MARMARINA products may vary, but (except as set out above) possible changes will not affect orders in respect of which a Dispatch Confirmation has already been sent.

Given the particularities of online shopping, the price of the products indicated on the WEBSITE refers solely and exclusively to the purchases made on it, without necessarily coinciding with the retail price of other establishments associated with MARMARINA. In accordance with the above, the price indicated on the WEBSITE is only considered binding for online purchases and in no way binds the establishments associated with MARMARINA.

The prices on the website include VAT, but exclude shipping costs, which will be added to the total amount due and will be indicated to the customer in a broken down manner.

Once the customer has made their purchases, all the items they wish to purchase will have been added to their bag and the next step will be to process the order and make the payment. To do so, the customer will follow 6 steps:

  1. You will click on "View Cart" at the top of the page to incorporate the products you wish to purchase.
  2. You will check that the selected items, their customization, additional options and quantities are correct and then click on "Continue".
  3. You will fill in and verify your contact information, your order details, and the address to which you want your order shipped.
  4. You will choose the payment method with which you want to make the purchase (credit card, bank transfer or PayPal) and enter the corresponding information.
  5. You will agree to the "Terms and Conditions".
  6. You will confirm the purchase by clicking "Place the order".

The customer can make the payment with Visa cards, PayPal, in installments through the financial company Aplazame (valid exclusively for purchases made with cards issued in Spain) or gift voucher. To minimize the risk of unauthorized access, you will be redirected to the virtual payment gateway/PayPal screen that will authorize the payment of the order.

Credit cards will be subject to checks and authorisations by the issuing entity; if said entity does not authorise the payment, MARMARINA is not responsible for any delay or lack of delivery and, ultimately, for not proceeding to formalise the sales contract with the customer.

Value Added Tax (VAT)

In orders destined for Ceuta and Melilla, deliveries would be exempt from VAT without prejudice to the application of the corresponding taxes and duties in accordance with the regulations in force in each of them.

5. Shipping

All shipments have a cost of € 4.95 (Peninsula).

Free shipping for purchases over €89 (Peninsula and Balearic Islands).

Estimated shipping times within the peninsula are 1 to 3 working days from the time the order goes out for delivery (*).

The shipment will be made by a company outside MARMARINA that undertakes to deliver the product paid for by the customer to the delivery address within an approximate period of:

(*) These periods can be extended up to 45 days for some of the following reasons:

  • Product customization
  • Special Items
  • Unforeseen circumstances not attributable to MARMARINA
  • Out of stock

If for any reason we are unable to meet the delivery date, we will inform you of this circumstance and the customer will be given the option of going ahead with the purchase by setting a new delivery date or cancelling the order with a full refund of the price paid. It should be noted in any case that deliveries are not made on Saturdays, Sundays or holidays.

For the purposes of these Conditions, it will be understood that the delivery has taken place or that the product(s) have been delivered at the time of signing for the receipt of the same at the agreed delivery address.

The risks of the Products shall be borne by the customer from the time of delivery.

The customer will acquire ownership of the products when full payment of all amounts due in relation to the products, including shipping charges, is received.

Important: In the event that customs holds the package, the recipient will be responsible for paying any processing costs, fees, customs handling costs, associated taxes, or any other additional costs. This condition is accepted when making the purchase. In the event that the item arrives at its destination and the customer refuses to pay the customs and handling fees, this amount will be deducted from the return of the product.

6. Return

If for any reason purchasers of MARMARINA products are not satisfied with the product received, they have the option of returning it. You have a period of 14 days from the receipt of your order to communicate it, by writing to our email info@marmarina.com with the following information:

  • Order reference number, full name and email address with which the order was placed.
  • Reason for return or exchange.
  • If you want a refund or exchange for another product.

In the event that the return is for reasons beyond MARMARINA's control, the shipping costs will be borne by the customer. Only returns of products that are in perfect condition, unused and in their original packaging will be accepted.

Changes caused by a change of opinion or errors made by the customer during the purchase process are considered causes not attributable to MARMARINA. If the product has a manufacturing defect or an error in shipping (and only in these cases), MARMARINA may authorize the return at our expense, after communication by email. In this case, a copy of the authorisation document must be attached to the shipment.

If the return is justified, MARMARINA will cover the shipping costs, provided that the customer has notified this circumstance upon receipt of the order. The customer may choose to receive a replacement product or request a refund, which will be made within a maximum period of 15 working days from receipt of the returned item.

Important: All personalised products (such as wedding, christening or communion invitations, personalised gifts, hangers, posters, stamps or any personalised stationery) are excluded from this return policy.

Remember that we transcribe verbatim the information you provide us in the personalization fields. We recommend that you review in detail before confirming your order. In some cases, we will send you a preview so that you can verify all the information, since once printed or sent to production, errors cannot be corrected.

7. Cancellation or modification

If for any reason any of these situations have existed when making the purchase:

  • You have entered an incorrect piece of information.
  • Choosing the wrong model or product.
  • You want to cancel your order.

Important: We will only be able to make modifications or cancel the order if the product has not entered the preparation phase.

8. Warranty

MARMARINA offers its customers products and services of the highest quality.

Given the special characteristics of the products marketed by MARMARINA on its website, there are slight differences between each product or service purchased, mainly due to the uniqueness and exclusivity of each and every one of the materials and finishes used in their manufacture, which is also largely handmade. Therefore, no two MARMARINA products or services are exactly the same and, in any case, it is inevitable that the product delivered to the customer will differ slightly from the one shown in the photographs included in the purchase process on the website (even if it had been the same). In no case will these differences imply the delivery of products or services with worse quality materials than those expressly mentioned on the Portal. Likewise, the customer is informed and is aware that the size of the photographs contained in the Portal does not correspond to the real size of the MARMARINA products offered.

Therefore, the client is informed and expressly consents to these circumstances and differences, without them being cause for termination of the Contract.

9. Basic care

To ensure that your MARMARINA products, invitations, cards, decoration items, accessories and details are kept in perfect condition, we recommend following a few simple cares:

  • Avoid contact with liquids and chemicals: To prolong the quality of your stationery, avoid contact with water, cosmetics or cleaning products, as they can deteriorate colors or textures.
  • Proper storage: Store your invitations, cards and gifts in a dry place, protected from direct sunlight to prevent the colors from fading. If possible, use protective envelopes or boxes to prevent damage.
  • Gentle handling: Try to handle the pieces with clean and dry hands to avoid stains. For more delicate posters or cards, hold them by the edges to maintain their integrity.
  • Protection against bumps and scratches: Many of our products are delicate and can be easily damaged. Prevents scratches or bumps during handling or transport, as the surfaces of some items may be fragile or sensitive to physical damage.

11. Competent jurisdiction and applicable law

For any dispute arising from this online sales contract, the Spanish courts will have jurisdiction. Likewise, Spanish law (Consolidated Text of the General Law for the Defense of Consumers and Users) will be applicable in everything that is not provided for in this contract.

The European Commission offers a platform for alternative dispute resolution, which can be accessed from: http://ec.europa.eu/consumers/odr/. MARMARINA is not a member of any association or organisation that offers an out-of-court dispute resolution system.

12. Intellectual Property and Proprietary Property

All content (including graphic design, source code, logos, texts, graphics, illustrations, photographs, trade names, trademarks or distinctive signs and any elements that appear on the WEBSITE), unless expressly stated otherwise, are the exclusive property of MARMARINA or third parties.

No intellectual or industrial property rights are transferred to the client over the WEBSITE or any of its component elements, and the client is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting, reusing, forwarding or using any of them, by any means or procedure, except in cases where it is legally permitted or authorised by the owner of the website. the corresponding rights.

13. Availability of the online shopping service

The Service will be available on a permanent basis twenty-four hours a day, 24 hours a day. MARMARINA informs the buyer that anomalies or interruptions may occur in the availability or operation of the Service due to causes not attributable to MARMARINA (technical problems of Internet providers, telecommunications, problems in the buyer's terminal, etc.), so the period for making the purchase may be extended.
